Picture Perfect Yorkies Agreement Policy |
It is hereby agreed between Picture Perfect Yorkies (hereinafter “seller” and ____________________ (hereinafter “buyer”) as follows: 1 . That seller will sell to buyer a male/female puppy(ies) from litter ___________________________ for the purchase price of $__________________ . Receipt of said sum is hereby acknowledged. 2 . Every effort will be made by (seller) to insure that the dog(s) is/are delivered in a healthy and sound condition. In order to facilitate this, there will be an examination of the puppy(ies) by a licensed veterinarian before the delivery of the puppy(ies) and the buyer will receive a certificate of good health at the time of delivery. In order to activate the guarantee as described herein, it will be necessary for the buyer to have an examination by a veterinarian, at the buyer's expense within 72 hours of the puppy leaving the seller's kennel and to provide proof of such examination to seller within seven days of the date of delivery 3 . If the buyer complies with the veterinarian’s examination as set forth in paragraph 1, then the seller guarantees the puppy until 1 year of age against any life threatening congenital defects. If the puppy has a life threatening congenital defect it will be replaced with the first available puppy of the same value from the seller, as soon as possible. However, the original puppy must be returned (at the buyer's expense) before a new puppy can be delivered. The seller will pay for the expense of sending the replacement puppy as well as the crates or kennels used in the shipping. In the event of death, an autopsy must be performed, (at the buyer’s expense), by a licensed veterinarian of the seller's choice to determine the exact cause of death. 4 . It is expressly understood that hypoglycemia is excluded from this guarantee. The seller has informed the buyer of the signs of hypoglycemia and instructed buyer to call a licensed veterinarian for immediate care. 5 . This Guarantee is not assignable and is not valid if the puppy dog is sold to a third party. 6 . The seller is not responsible for any veterinarian bills the purchaser may incur regarding said puppy prior to notification of the congenital condition. 7 . Seller's sole liability on the above guarantee shall be limited to replacement with a puppy of equal value. In no event will seller be liable for any expense incurred by the buyer. There are no refunds!!! No exceptions!! 8 . Other than the guarantee set forth herein, there are no other warranties, express or implied. Seller does not guarantee size of yorkie puppies. 9 . The buyer agrees to never sell said puppy to a pet shop, broker, or puppy mill. 10 . In the event the buyer is unable to keep said puppy(ies) for any reason, the seller is to be given notice of the intent to sell or transfer the puppy and an opportunity reacquire the puppy(ies) at the option of the seller. 11 . The seller agrees to provide AKC paperwork to the buyer so that the buyer may register said puppy. 12. Buyer of puppy(ies) agrees to feed and purchase the exact type of food that puppy is accustomed to or warranty of said puppy(ies) will be null and void. 13 . It is agreed and understood that the execution of this Agreement has involved transaction of business within the state of Missouri and that the law of the state of Missouri will govern the interpretation of this Agreement. THIS IS A LEGALLY BINDING DOCUMENT. BY SIGNING BELOW YOU ARE ACKNOWLEDGING THAT YOU HAVE READ THIS AGREEMENT AND THAT YOU UNDERSTOOD ALL OF THE TERMS SET FORTH THEREIN AND THAT YOU ARE AGREEING TO THEM.
